Two kinds of moats, rubies and resources right? Are they permanent or do they get used up by attacks?

The moats themselves are permanent just like walls. You can however make tools to put in the moat just like you can on the walls. These tools will be used up during attacks.

The resources moat gives you 10% defense bonus. The Ruby one gives 20%.

is there really such a big difference between a regular moat and a castle moat?

There is no "regulr" moat. There is just the castle moat.

Big difference would be 10% and the other 50%

The bonuses in the end don't make much of a difference (10% ressources vs 20% ruby). What does make a big difference, is the tools you can add to it (sharpened stakes +35% ressources vs swamp snappers +80% ruby).
Since a Castle Moat costs 12 500 rubies, it's quite a lot of rubies just for an additionnal 10% bonus to defence. I suppose you could wait until oh-so-rare 50% off everything purchasable with rubies event occurs, but then again, 6 225 is still quite a lot of rubies wasted for little in my humble opinion. While the support tools Swamp Snappers cost only 36 rubies and provide an additionnal 80% defence, which is 45% more than the Sharpened Stakes provide (+35%). It's a much better use of your rubies to save them for Swamp Snappers in tight situations, or then again simply saving your rubies to upgrade your Bakeries in every food outpost you have would be a much better use of your rubies if you don't buy rubies.

you can only make it from level 37 by clicking the up button next to the pic of the moat, this can only be done is a slot is open

yes you do i believe the level to get a moat is level 37 then 39 for research tower

i no i am not ruby player but i am leveling up fast and i am not about to pay 21K stone and 13K wood for a moat! or 12K rubies. i mean if you are lvl 39, you got lotta recources, but i have bought rubies once ($2.99) and i donate them to the allience as soon as i get em. since i am kinda low on recources right now, it looks like im not havin a moat even when i get lvl 39!
